CONFIDENTIALITY
STATUTES AND RULES
There are different statutes and rules regarding confidentiality in
Michigan depending on the type of records involved.
Michigan passed legislation governing access to non-mental health
medical records. See Brian's article on that statute's provisions
regarding access and confidentiality.

If there is any mention of HIV/AIDS
(including that the person is HIV-negative), then the Michigan HIV/AIDS
statutes apply to the records.

If the records concern treatment for mental
illness by a "mental health care provider". Then the mental
health rules apply. The "mental health care provider" designation
is to distinguish between a general practitioner or internist treating
depression with an anti-depressant medication, and a professional whose
area of expertise is mental health care.

If the records concern
treatment for substance abuse at a licensed substance abuse
treatment center or a dedicated unit at a hospital, then the
federal substance abuse regulations apply.
